Restatement of Foreign Relations Law of the United States

Overview

"The foreign relations law of the United States, as dealt with in this Restatement, consists of (a) international law as it applies to the United States; and (b) domestic law that has substantial significance for the foreign relations of the United States or has other substantial international consequences." Restatement (Third) Foreign Relations Law § 1 (Am. Law Inst. 1987).

The Restatement of the Law, Fourth: The Foreign Relations Law of the United States was published in 2018. The fourth series is only a partial revision of the third series. Select case citation sources to the fourth series of Foreign Relations Law may include citations to superseded sections of the second and third series of the Restatement of Foreign Relations Law. Use the Parallel Tables to find the corresponding section numbers between series of Restatements.

The Restatement of the Law, Third: The Foreign Relations Law of the United States was published in 1987. Select case citation sources to the third series of Foreign Relations Law may include case citations from the second series of the Restatement of Foreign Relations Law.

The Restatement, Second, Foreign Relations Law of the United States was published in 1965. The Restatements for the Foreign Relations Law of the United States began with the second series. Select case citation sources may include case citations to the second series of the Restatement of Foreign Relations Law with the third series of Foreign Relations Law.

The Restatement of the Law, Fourth: Foreign Relations Law of the United States is a partial revision of the Third Series, covering treaties, jurisdiction, and sovereign immunity. Superseded status information is available at the beginning of each "Part" of the Foreign Relations Law of the United States, Fourth. Furthermore, "the provisions of the Third Restatement remain the position of The American Law Institute except where superseded by provisions in this Fourth Restatement." The Restatement of the Law, Third: Foreign Relations Law of the United States "is a comprehensive revision of the Restatement of the Foreign Relations Law of the United States which The American Law Institute published in 1965. Although this revision is somewhat different in style, covers many more subjects, and reflects important developments in the intervening decades, it stands on the shoulders of the previous Restatement."
